Terms of Service

These Terms of Service ("Terms") govern your use of the Yearly mobile application ("App") operated by Sparkonaut ApS ("we", "our", or "us"). By using the App, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use Yearly. By using the App, you represent that you meet this age requirement. If you are under 18, you confirm that you have obtained parental or guardian consent to use the App.

2. Account Registration

To use Yearly, you must create an account using Sign in with Apple, Google, Facebook, or Spotify. You are responsible for:

• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

You may only create one account per person. We reserve the right to terminate duplicate accounts.

3. License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. This license does not include the right to:

• Modify, copy, or distribute the App
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, or lend the App to third parties
• Use the App for any commercial purpose

4. User Conduct

When using Yearly, you agree not to:

• Use cheats, exploits, automation software, or any unauthorized third-party tools
• Interfere with or disrupt the App or servers
• Attempt to gain unauthorized access to any part of the App
• Harass, abuse, or harm other users
• Violate any applicable laws or regulations
• Impersonate any person or entity

5. Intellectual Property

All content in the App, including but not limited to graphics, text, images, audio, and software, is owned by Sparkonaut ApS or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use any content from the App without our prior written permission.

6. Termination

We may suspend or terminate your account and access to the App at any time, with or without cause, including for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Conduct that harms other users or the App

You may delete your account at any time by contacting us at contact@sparkonaut.com.

7. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SPARKONAUT APS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR €100, WHICHEVER IS GREATER.

9. Governing Law

These Terms are governed by the laws of the European Union and the laws of Denmark, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Denmark, unless EU consumer protection laws provide otherwise.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by updating the "Last updated" date and, where appropriate, through in-app notifications. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.
